General

• The following terms and conditions apply to all our deliveries and agreements unless otherwise agreed in writing. Any terms and conditions of the buyer that we have not expressly acknowledged in writing are not binding on us, even if we have not expressly objected to them.

• Placing an order implies acceptance of these terms and conditions by the buyer. All previous price lists and terms and conditions are null and void.

• All offers are non-binding, subject to availability and dependent on growth and weather conditions.

Prices

• All prices are ex-nursery(Lucassen Boomkwekerij) in euros, excluding VAT, import duties, other taxes and charges, costs of phytosanitary testing, multiple-use packaging materials and any other costs.

• Prices of youngplants in Tray24/P9 are including tray. Youngplants in tray can also be delivered pot-ready in HVM-boxes at no extra cost.

• All packaging costs are always calculated separately on the invoice. Under no circumstances will packaging materials be included in the plant prices.

Force Majeure

• In the event of force majeure, the seller may rescind the agreement fully or partially, or postpone delivery for the duration of the force majeure.

• Force majeure includes, but is not limited to, circumstances such as civil commotion, war, strikes, natural disasters, epidemics, pandemics, terrorism, adverse weather conditions, traffic conditions such as roadblocks, roadworks or traffic jams, fire and government measures.

• An example of force majeure is if the Seller’s bank applies or will apply regulations which may result in the Seller’s relationship with this bank being terminated or being at risk of termination if the agreement between the Seller and the Buyer is maintained.

Multiple-use packaging

• Multiple-use packaging materials, such as pallets, VML and VMH, will be charged to the Buyer.

• Multiple-use packaging materials can be returned within 30 days after delivery, assuming reasonablecondition. Cost of transportation will always be at Buyer.

• The Buyer must immediately exchange CC-TAG6 containers and CC-shelves and in good condition. If direct exchange is not possible, the delivery will be cancelled. The CC-TAG6 label must be legal and willbe scanned by us. We do not accept fake labels!

Guarantees

• Plant volume and quality: The seller only guarantees the pot sizes of the plants. Heights or diameters are only given as indications without obligation.

• The seller does not under any circumstances guarantee the growth, bloom, or repossession of the supplied plants, even another explicit agreement to the contrary.

Call-off & Reservations

• Orders must be placed by email at least 2 working days before the desired delivery date. Delivery timeyoungplants in growtray always in consultation, sometimes we need more time.

• A reservation request may be refused by the seller. Seller may request a deposit for accept an orderreservation. Placed order reservations cannot be cancelled.

• When placing an order reservation, the buyer must indicate whether the order is intende for autumn-delivery or spring-delivery. Autumn-reservations must be taken before 20 December 2025. Spring-reservations must be taken before 17 April 2026.

Packaging costs & attaching supplied labels:

• Pallet box 120x100x100: € 30,00

• Pallet box ISPM (heat treated) 120x100x100: € 32.50

• Pallet 100x120: € 10,00

• Euro pallet: 18,60

• VMH: 4,00

• VML: 3,25

• Service for attaching supplied adhesive labels or slotted labels to the plant: € 0,15 per pcs.

Payment & claims

• Payment must be made in Euro currency to our bank account.

• Payments must be made within 30 days net. If the payment term is exceeded, we will charge 2%interest per month. All costs arising from late payment are borne by the buyer.

• Pre-payment: We will send you a pro forma invoice with 100% of the order value. You pay beforedelivery and after delivery you receive an invoice document which all costs are described and thecontents are stated.

• Lucassen Boomkwekerij will in no case accept a liability claim higher than the invoice sum, excludingpallet and transportation fees. Pallet and transportation fees are not subject to liability claims. We willaccept no responsibility for possible damage incurred after delivery.

• Complaints must be reported in writing within 3 working days from delivery included with photos, thiswill expedite the process.

Finally

• All information provide by us is subject to typing errors, print errors, mistakes and/or priceadaptations.

• Translations of these terms and conditions of sale are issued for information purposes only. The Dutchtext is the only which is legally valid.

• In addition to the above terms of delivery and payment, all of our transactions are subject to the LTONederland General International Terms and Conditions of Sale and Delivery for tree nursery products,plants (including perennials), shrubs and summer flowers filed with the District Court of The Hague on25 May 2020. As well as the Trade Conditions for Tree Nurseries in the Netherlands 2020.(Handelsvoorwaarden voor de Boomkwekerij in Nederland – HBN 2020).
